A First rate article: May 4 - The Performance of a Lifetime. at the Cracked Mirror.

.........Victories could also be pyrrhic, as in the case of William Roache whom Carter-Ruck encouraged to sue The Sun for saying he was boring. Roache was awarded £50,000 but as the paper had already paid that amount into court, Roache ended up having to pay his own costs and those of The Sun. He tried to sue Carter-Ruck but was unsuccessful and declared bankruptcy.

In 1980, Daily Express editor Derek Jameson had been advised by Carter-Ruck that if he sued the BBC over their portrayal of him in a Weekending sketch, he would win at least £25,000 in damages. The barrister in the case, David Eady QC, however advised Carter-Ruck to accept the BBC's offer to settle for £10 (sic) plus costs. Carter Ruck did not disclose this advice to his client. The jury found the broadcast defamatory, but also fair comment and Jameson had to pay costs.[3], receiving a bill for £41,342.50 from Carter-Ruck. Jameson learned by chance of the QC's advice and Carter-Ruck's former partner David Hooper claimed that "Carter-Ruck told him a string of lies".[4] Carter-Ruck later claimed that he did not want to undermine Jameson's morale in court.[5]

Did someone mention Pinochet? one from the archives, rather aptly named I thought.

MacIntyre, who has exposed drug dealers and soccer hooligans, believes the abductors were in the apartment when Gerry went to check on Madeleine and her two siblings.

The McCanns’ investigators say they are already probing MacIntyre’s findings and agree with most of his theories.

Dave Edgar Is Still a Cunt

And very unlikely to loose his first place spot in the rankings.

But of all the drivel in the article it is this sentence that takes the biscuit and again confirms his rightful place as number one.

In spite of me highlighting it, Edgar would probably still look at the sentence and say "whats wrong with that?"

But the former RUC detective sergeant’s team will never be able to use it as Portuguese authorities will not give him access to forensic information.

You're a star, you really are.

A controversial DNA test used in the failed Omagh bomb case is the key to finding Madeleine McCann’s kidnapper, Ulster investigator Dave Edgar has claimed.

But the former RUC detective sergeant’s team will never be able to use it as Portuguese authorities will not give him access to forensic information.

Speaking exclusively to Sunday Life at the HQ of his Alpha Investigations Group in Cheshire, the ex-cop leading the search for Maddie believes that DNA tests, which can establish a profile from just a few cells, could help solve the mystery.

Edgar said he tries to maintain “a decent relationship” with Algarve cops but has blasted them for contaminating the scene of her disappearance.

Edgar said he tries to maintain “a decent relationship” with Algarve cops but has blasted them for contaminating the scene of her disappearance.

He claimed if Low Copy Number (LCN) DNA testing had been carried out at the Ocean Club resort in Praia da Luz, where Maddie vanished from two years and four months ago, it is “highly likely” her abductor would have been nailed. more Belfast Telegraph

Fuck All Sir, You Know Absolutely Fuck All

Donal MacIntyre, another wanker talking through his arse to further an agenda, what or who's I don't know, but rest assured it's not Madeleine McCanns or the pursuit of justice for that matter, and most definitely it is not one of decency.

Just what does this tosser think we have all been doing for the last two years if not picking over every word, every action and every nuance of this shabby bunch?
Yet this twat goes on a two week boondoggle to the Algarve and he has the whole thing sorted, the fuck he does.

Rightly so the web is ablaze over the drivel this fucker has managed to dream up so it saves me a rant, but now it really is getting beyond shameful, beyond disgusting.

But not as disgusting as the two people who have turned their daughter into the most famous little whore in the world. A poor dead little kid that all the pimps are living off, and not an ounce of shame between the fucking lot of 'em.

I hope you are proud of yourselves.

I KNOW HOW MADELEINE WAS TAKEN
Donal MacIntyre

MADELEINE McCann was abducted by at least two kidnappers who must have carried out several dry runs in the days leading up to her disappearance.

and repeatedly came within seconds of capture - see below

After spending a week on the ground investigating the case and the methods used by the kidnappers, I can only conclude that they must have entered the apartment to carry out a rehearsal, because they were working to an incredibly tight schedule.

There are other conclusions available. And why only one rehearsal among 'several dry runs'? Presumably they entered via the patio doors. So why didn't Gerry do the same?

The three-minute time frame they allowed themselves left no margin for error.

I think you'll find, Donal, that after studying the movements of the McCanns for several days and noticing that their conscientious return visits to the apartment were regular as clockwork at twenty minute intervals, the criminals would have allowed themselves fifteen minutes, not three

But even though they did their homework with meticulous care, they still came within seconds of capture.

and on more than one occasion

I believe the focus of the investigation for the private investigators hired by Madeleine's parents should be on a breakdown of who was in and around the Mark Warner Ocean Club in Praia da Luz throughout their holiday.

The PJ thought the same. Unfortunately, the Tapas 7 begged to differ. On the plus side, we do have a collection of Rogatory Interviews, and the private investigators don’t have to travel all over Europe to question them further. more

Things my Daddy told me.

My father, to put it mildly, was a hard bugger, a hard bugger and his own man.

It must have been sometime back in the thirties when some cop or other made the mistake of, to use the contemporary phrase, dissing my old feller.

Not surprisingly then that the cop was told to go fuck himself, and I suppose equally without surprise the old man found himself arrested on a charge of using obscene language in a public place.

Now he wasn't terribly phased about this, but what did concern him was having a conviction at a time when he needed to be squeaky clean because of some job he was applying for.

Having little option other than to lawyer up, daddy consults a no nonsense Yorkshire lawyer.

"You tell me the truth and let me tell the lies." was the lawyers opening gambit, fair enough says father and puts his cards on the table.

A simple defence by our no nonsense lawyer, "Why would my client go to all this trouble and expense in order to avoid a ten shilling fine, quite simply your honour because he is not guilty."

Case dismissed, father got the job he wanted, not to mention gaining an enemy for life in the local plod.
.

And while I'm scribbling. Were I innocent and someone falsely accused me of offing my daughter, understandably I would be a tad vexed and quite motivated to do one of two things.

I would invite my accuser to meet me in a public forum, counter every question put to me with the truth, and in doing so dismiss forever any doubts that my accuser or the public held regarding my involvement in her demise.

The other option, though somewhat less sophisticated, would be to jump on a plane, knock on my accuser's door, and when he answered it, proceed to beat the shit out of him.

As I say, hardly sophisticated, but extremely satisfying. That's what I would do if I were innocent.

Deja Bloody Vous, Spot The Pattern, Spot The Players, Spot The Bullshit.

The Guardian can reveal evidence today of a massive cover-up by the British oil trader Trafigura, in one of the worst pollution disasters in recent history......

Trafigura has been publicly insisting for three years that its waste was routine and harmless. It claims it was "absolutely not dangerous".......

Trafigura's libel lawyers, Carter-Ruck, recently demanded the Guardian deleted published articles, saying it was "gravely defamatory" and "untrue" to say Trafigura's waste had been dumped cheaply and could have caused deaths and serious injuries. The Dutch paper Volkskrant and Norwegian TV said they were yesterday also threatened with gagging actionsTrafigura also launched a libel action against the BBC's Newsnight, complaining it had been wrongly accused of causing deaths, disfigurement and miscarriages, and had "suffered serious damage to their reputation". The BBC filed a fighting defence this week, accusing Trafigura of knowing its chemicals were "highly toxic, potentially lethal and posed a serious risk to public health". The broadcaster also alleged a cover-up, saying Trafigura's denials "lack credibility and candour".......

Trafigura's lobbyists, Bell Pottinger, claimed to be "appalled" by the report, saying it was "premature", "inaccurate", "potentially damaging", "poorly researched", and "deeply flawed"........

Trafigura said it "utterly rejected" claims of a cover-up. more the Guardian, or if you struggle as I with the Guardian, a different link here.

Question: Do you think it was a mere coincidence, the fact that the judge who decided over the apprehension of your book was the same who condemned the Portuguese State to pay 131 thousand euro of compensation to Paulo Pedroso?

If anybody has photo's of her Ladyship (judge Amélia Maria de Matos Puna Loupo and would care to send them to me it would be appreciated, thanks.

Just Who Is Looking? A Bit Of Common Sense

Thank you to the author, nothing to add.

By Dimsie The Maddie Case Files.

I've never been sure who these people who've stopped looking for Madeleine because of GA's book actually are. They can't be the McCanns' friends and relations because obviously they believe every word Kate and Gerry say about the 'abduction' and so will be ignoring anything Amaral says to the contrary. They can't be the pro's that keep popping up in forums to tell us how we're all wrong and how dreadful Amaral is (and Tony Bennett too, of course), because they too are convinced Amaral is a monster for not believing in the 'abduction' and so they'll ignore him. They can't be members of the public
because most members of the public have jobs to go to, families to look after, lives of their own to lead, and are far too busy to head off somewhere looking for Madeleine. So who are they? Who has stopped looking for Madeleine because of Amaral's
book?

Come to think of it, who has STARTED looking for Madeleine? I haven't read any reports in the papers about the friends and relatives of the McCanns combing the wilder parts of the area around PdL where Edgar informs us she's being held. I can't see how the pro's who spend their time writing rubbish about the rest of us can have any time left over to join search parties; how many of THEM are in Portugal, knocking on doors and asking to inspect people's cellars? I don't know of any member of the public who's gone anywhere looking for Madeleine, let alone join Dave and Arthur for a tramp around the lawless wastelands of the Algarve, where presumably white man has not yet laid foot. I don't think either of Madeleine's parents is in Portugal, co-ordinating the search, though of course I could be wrong. Maybe we'll hear tomorrow that now that Kate has translated the files she's off to Portugal to tell the PJ how to start this most important search. But until I see it on tv I won't believe it.
.

Hmm, it seems NO ONE is looking for Madeleine, except a couple of incompetent (according to the Mail on Sunday) ex-cops, whose opinions change from one week to the next and who think that the way to find a child they're sure is entombed in a cellar in Portugal is to take a trip to Australia.

The Not So Political Correct Gallery

Let us get a little political this morning, after all there's plenty of it about.

‘The Committee’

by Tim Logan

Sean McPhilemy’s banned book, The Committee, exposes the RUC Death Squads and their links with the ‘establishment’ in northern Ireland

Sean McPhilemy’s banned book The Committee makes sensational claims of inextricable links between David Trimble and prominent members of the Unionist establishment accused of ordering the murder of political opponents.

Trimble and his now-deceased constituent ‘King Rat’, the Loyalist Volunteer Force leader, Billy Wright may not have been close but they were intimate enough to indulge tête-à-tête witnessed by the BBC’s Peter Taylor, in the midst of a stand-off at Drumcree. This may have been considered by many as an ordinary encounter between a high-profile politician and an unemployed working-class man with limited formal education. While one was assured and confident, the other was eager to please and uncomfortable: However, it was Trimble who was sweating. more of this short review

Unfortunately I have to head out shortly and I'm loathe to post something that I haven't read in it's entirety, but having quickly scanned the article, why not, or warum nicht as the Germans might say.

From my quick glance the article below embraces quite a few things that may be of interest and relevance, be it publishing, libel and the rest, Edgar being ex-RUC and let's not forget our venerable Chief Constable Matt Baggott, off to his new post as the head of the PSNI, the RUC in all but name.

Whereas it might seem history now, I did at the time read "The Committee" and to put it ever so mildly I found it a tad thought provoking.

David Trimble is maintaining his suit against Amazon.com despite the fact that the book is no longer available on Amazon. co.uk. But there are two additional reasons why Amazon.com need not be worried about it. First, any libel judgment against Amazon in the U.K. will be enforced only against its assets located in the U.K. And, assuming that Amazon.co.uk is a subsidiary corporation and not simply a division of Amazon.com, English solicitors maintain that its assets cannot be used to satisfy a judgment against the U.S.-based parent. Second, there is an increasing trend among U.S. courts to refuse to enforce English libel judgments transferred to the U.S. because they are the product of a system which is contrary to the public policy of the United States.

The ultimate outcome of the U.K. suits against Amazon and Barnes & Noble, therefore, is that the U.K. libel system will not be able to impose its standards on books shipped from the United States. Equally important, English solicitors will no longer be able to effectively ban books in the U.K. simply by threatening to sue a bookseller. They can limit access, but banned books in the U.K. are a thing of the past thanks to U.S.-based online booksellers.

As to the other issues, the bottom line is that the British libel regime has resulted in the publication of a bestseller in the United States that credibly accuses the first minister - designate of the new government of Northern Ireland A number of separate systems of government exist or have existed in Northern Ireland.
of providing political cover for terrorists. The U.S. libel regime is far less likely to have produced such a result. more http://www.thefreelibrary.com/TRUTH,TERROR,AND DAVID TRIMBLE

Update:
I have finally sat down and read the article through, if you have no wish to embrace the political aspect then simply ignore it, but the information given about publishing in the US and the sale of books to the UK via Amazon US is interesting enough.

.................One issue arising from this tangle of cases is straightforward. Does the David Trimble lawsuit against Amazon.corn, along with policeman Trevor Forbes' lawsuit against Barnes & Noble, endangerthe future of Internet book sales in Britain by U.S. booksellers? In a word, no.

While it is true that U.K.-based booksellers, including Amazon's U.K. subsidiary, have removed the book from their Web sites, the major U.S. online booksellers - Amazon, Barnes & Noble, and Borders - continue to sell and ship the book to customers in the U.K. (The book's U.S. publisher, Roberts Rinehart of Colorado, no longer accepts orders for the book placed by customers in the U.K. on its Web site.) When asked why Amazon had taken the book off its U.K. Web site but still made it available on its U.S.-based Web site for sale to U.K. customers, Simon Murdoch Simon Murdoch, (b. 1948 - ). New Zealand diplomat and public servant. Currently New Zealand’s Secretary of Foreign Affairs and Trade. Previously New Zealand High Commissioner to Canberra, and Chief Executive of the Department of Prime Minister and Cabinet. , managing director of Amazon.co.uk and vice president of Amazon.com, explained: "From a legal point of view, it's actually quite a big distinction. The situation is, if you actually buy the book from any company in the States, as I understand, you would be actually bringing the book in yourself as an individual."...........

Book Stays: Claim and Counter Claim

The ruling by judge Amelia Puna Loupo that bans the sale of "Maddie: The Truth Of The Lie," will not have a direct impact on sales for the moment, in Portugal and anywhere else. This is because the order has not been completely formalised, as has been admitted by the lawyer representing the McCann family in this case............

....If the higher court decides in their favour, Amaral and the publishers can go ahead with demands for compensation against the McCanns (for actual damage caused) and as individuals, against the judge Amelia Puna Loupo (for an illegal decision causing serious prejudice). more

Madeleine McCann 'is in a secret lair'

Ulster detective leading the hunt on why he thinks she’s being held captive just like Jaycee Dugard.

By Aaron Tinney
Sunday, 13 September 2009

The Ulster detective leading the search for Madeleine McCann today reveals his most chilling theories yet, exclusively to Sunday Life. Hardened ex-RUC cop Dave Edgar told us he is convinced that little Maddie is imprisoned in a hellish lair – just like kidnapped sex slave Jaycee Lee Dugard.

He insisted the “back from the dead” reappearance of Jaycee – and the cases of Austrian cellar girls Elisabeth Fritzl and Natascha Kampusch – confirmed his suspicion.

And despite fresh leads taking his probe to Australia and Barcelona, the east Belfast man insists the golden-haired youngster is being held just 10 miles from where she was snatched in Praia da Luz two years ago.

But he warned that the sprawling wilderness where he believes Maddie is languishing is almost impossible to search completely.

Belfast-born Dave revealed the grim theories when he opened his case files to us.

We spent the day at the Cheshire office he uses to conduct the world’s biggest missing person case.

Sunday Life can now lift the lid on how his Alpha Investigations Group private eye agency really operates and what it is like to search for the world’s most famous missing youngster, who disappeared two years, four months and 10 days ago.

When we visited Dave’s headquarters, US kidnap victim Jaycee Lee Dugard had still not been rescued and the world had long forgotten her name.

But even then Dave said he was convinced Maddie was entombed by an abductor in a cellar or dungeon, like Austrian cellar victims Natascha Kampusch and Elisabeth Fritzl.

“Maddie is most likely being held captive, possibly in an underground cellar, just like Natascha or Elisabeth, and could emerge at any time,” he told us.
